Palestinians certain to win recognition as a state in United Nations vote

UNITED NATIONS (AP) ? The Palestinians are certain to win U.N. recognition as a state Thursday but success could exact a high price: Israel and the United States warn it could delay hopes of achieving an independent Palestinian state through peace talks with Israel.

The United States, Israel's closest ally, mounted an aggressive campaign to head off the General Assembly vote. Israeli Prime Minister Benjamin Netanyahu defiantly declared Thursday that the Palestinians would have to back down from long-held positions if they ever hope to gain independence.

Ahead of Thursday's vote, thousands of Palestinians from rival factions celebrated in the streets of the West Bank. Although the initiative will not immediately bring about independence, the Palestinians view it as a historic step in their quest for global recognition.

The United States, Israel's closest ally, mounted an aggressive campaign to head off the General Assembly vote.

In a last-ditch move Wednesday, U.S. Deputy Secretary of State William Burns made a personal appeal to Palestinian President Mahmoud Abbas promising that President Barack Obama would re-engage as a mediator in 2013 if Abbas abandoned the effort to seek statehood. The Palestinian leader refused, said Abbas aide Saeb Erekat.

With most of the 193 General Assembly member states sympathetic to the Palestinians, the vote is certain to succeed. Several key countries, including France, have recently announced they would support the move to elevate the Palestinians from the status of U.N. observer to nonmember observer state. However, a country's vote in favor of the status change does not automatically imply its individual recognition of a Palestine state, something that must be done bilaterally.

The Palestinians say they need U.N. recognition of a Palestinian state in the West Bank, Gaza and east Jerusalem, the lands Israel captured in 1967, to be able to resume negotiations with Israel. They say global recognition of the 1967 lines as the borders of Palestine is meant to salvage a peace deal, not sabotage it, as Israel claims.

The non-member observer state status could also open the way for possible war crimes charges against the Jewish state at the International Criminal Court.

Netanyahu warned the Palestinians Thursday that they would not win their hoped-for state until they recognize Israel as the Jewish homeland, declare an end to their conflict with the Jewish state and agree to security arrangements that protect Israel.

"The resolution in the U.N. today won't change anything on the ground," Netanyahu declared. "It won't advance the establishment of a Palestinian state, but rather, put it further off."

While Israel argues that Abbas is trying to dictate the outcome of border talks by going to the U.N., the recognition request presented to the world body in fact calls for a quick resumption of negotiations on all core issues of the conflict, including borders.

Netanyahu's predecessors accepted the 1967 lines as a basis for border talks. Netanyahu has rejected the idea, while pressing ahead with Jewish settlement building on war-won land, giving Abbas little incentive to negotiate.

For Abbas, the U.N. bid is crucial if he wants to maintain his leadership and relevance, especially following the recent conflict between his Hamas rivals in Gaza and Israel. The conflict saw the Islamic militant group claim victory and raise its standing in the Arab world, while Abbas' Fatah movement was sidelined and marginalized.

In a departure from previous opposition, the Hamas militant group, which rules the Gaza Strip, said it wouldn't interfere with the U.N. bid, and its supporters joined some of the celebrations Thursday.

In the West Bank city of Hebron, some in a crowd of several thousand raised green Hamas flags, while in the city of Ramallah, senior figures of Hamas and Islamic Jihad, two militant groups normally opposed to Abbas, addressed the crowd.

"It's the right step in the right direction," Nasser al-Shaer, a former deputy prime minister from Hamas, said of the U.N. bid.

The Palestinians chose the "International Day of Solidarity with the Palestinian People" for the vote. Before it takes place, there will be a morning of speeches by supporters focusing on the rights of the Palestinians. Abbas is scheduled to speak at that meeting, and again in the afternoon when he will present the case for Palestinian statehood in the General Assembly.

U.S. Secretary of State Hillary Clinton warned Wednesday that the U.N. vote will not fulfill the goal of independent Palestinian and Israeli states living side by side in peace, which the U.S. strongly supports because that requires direct negotiations.

"We need an environment conducive to that," she told reporters in Washington. "And we've urged both parties to refrain from actions that might in any way make a return to meaningful negotiations that focus on getting to a resolution more difficult."

The U.S. Congress has threatened financial sanctions if the Palestinians improve their status at the United Nations.

Ahead of the vote, Republican Sen. Orrin Hatch filed an amendment to a defense bill Wednesday that would eliminate funding for the United Nations if the General Assembly changes Palestine's status.

Israeli government spokesman Mark Regev said that by going to the U.N., the Palestinians violate "both the spirit and the word of signed agreements to solve issues through negotiations," which broke down four years ago.

But Israeli officials appeared to back away from threats of drastic measures if the Palestinians get U.N. approval, with officials suggesting the government would take steps only if the Palestinians use their new status to act against Israel.

Regev, meanwhile, affirmed that Israel is willing to resume talks without preconditions.

U.N. diplomats said they will be listening closely to Abbas' speech to the General Assembly on Thursday afternoon before the vote to see if he makes an offer of fresh negotiations with no strings, which could lead to new talks. The Palestinians have been demanding a freeze on Israeli settlements as a precondition.

As a sign of the importance Israel attaches to the vote, Israeli Foreign Minister Avigdor Lieberman flew to New York and was scheduled to meet Secretary-General Ban Ki-moon before the vote.

Unlike the Security Council, there are no vetoes in the General Assembly and the resolution to raise the Palestinian status from an observer to a nonmember observer state only requires a majority vote for approval. To date, 132 countries ? over two-thirds of the U.N. member states ? have recognized the state of Palestine.

The Palestinians have been courting Western nations, especially the Europeans, seen as critical to enhancing their international standing. A number have announced they will vote "yes" including France, Italy, Spain, Norway, Denmark and Switzerland. Those opposed or abstaining include the U.S., Israel, Germany, Canada, the Netherlands and Australia.

The Palestinians turned to the General Assembly after the United States announced it would veto their bid last fall for full U.N. membership until there is a peace deal with Israel.

Following last year's move by the Palestinians to join the U.N. cultural agency UNESCO, the U.S. withheld funds from the organization, which amount to 22 percent of its budget. The U.S. also withheld money from the Palestinians.

Businesses are seriously over-estimating the strength of their information security measures, leaving themselves open to being defrauded, and reducing their attractiveness to potential clients in emerging markets.

These are key findings in the 2013 PwC, CIO magazine and CSO magazine?s ?Global State of Information Security Survey??, and Nick Vermeulen, head of Advisory services at PwC Channel Islands, believes these issues are of vital importance to local businesses looking to expand eastwards.

The 10th annual survey of more than 9,300 top-ranking Executives from 128 countries found that 68 percent of respondents report confidence in the effectiveness of their organisation?s information security activities. In addition, nearly half (42 percent) view their organization as a ?front-runner? in information security strategy and execution.

However, the survey finds that only 8 percent actually qualify as true information security leaders.?PwC defines ?leaders? as companies that have a chief information security officer (or CISO equivalent) in place, have an overall information security strategy, have measured and reviewed the effectiveness of their security in the last year, and understand exactly what types of security events have occurred.

Also worryingly, in today?s world of ?big data,? the survey finds that most organizations are keeping looser tabs on their data today than in years past. Fewer than 35 percent of respondents said they have an accurate inventory of employee and customer personal data, and only 31 percent reported they had an accurate accounting of locations and jurisdictions of stored data.

Fewer than half of the respondents (45 percent) expect an increase in their information security budgets in the next 12 months, despite an increase in the number reporting 50 or more security incidents (13 percent). While multiple factors shape security budgets, the primary determinant is the economic environment and information security concerns are far down the list.

Nick Vermeulen highlights the fact that among all regions, Asia has the fewest respondents who expect a decrease in security budgets this year. For Asia, years of investment is now paying off as it leads the world in security practices and performance. As for keeping up with new challenges, Asia rates highly for mobile security initiatives and cloud security strategy.

Mr Vermeulen suggests this trend is highly relevant for our finance industries locally, which are affected by the global shift of capital flow to the east. He commented:

?We need to factor in the expectations these markets will have around how we do business with them. If we are to succeed in building strong relationships with them, we need information security that meets or exceeds their own standards and there will also quite likely be a high benchmark set for us to reach, on every aspect of how we use digital technology to do communicate and do business.?

He goes on to stress the urgent need for both islands to have strategies in place for developing a digital economy: ?We must ensure businesses operating from our islands have all the support they need both to get the basics right and transform their businesses to a digital model and prosper,? added Mr Vermeulen.

Three accused of plotting to join al Qaeda indicted in California

LOS ANGELES (Reuters) - Three men accused of plotting to join up with al Qaeda and Taliban militants for training in Afghanistan were indicted on Wednesday in California in a move that could allow prosecutors to move to trial more quickly.

But the four-page indictment, returned by a grand jury in Riverside, offered few details beyond those contained in a criminal complaint filed earlier this month against the men, all U.S. citizens or permanent residents.

The indictment charged Ralph Kenneth Deleon, 23, Miguel Alejandro Vidriales Santana, 21, and Arifeen David Gojali, 21, with conspiracy to provide material support to terrorists, the same charge contained in the complaint.

The filing of the indictment allows federal prosecutors to skip a preliminary hearing in which they would lay out their case and a judge would determine if there was enough evidence to merit a trial. The men each face up to 15 years in prison if convicted.

The three men had lived in Southern California's Inland Empire, east of Los Angeles, before their arrest on November 16, two days before they had planned to fly to Turkey via Mexico before heading on to Afghanistan, the FBI said at the time.

The suspected ringleader, Sohiel Omar Kabir, 34, is accused of recruiting the three men, two of whom converted to Islam under his influence. Kabir was apprehended this month in Afghanistan, but was not listed in Wednesday's indictment.

Kabir, who was charged in the previously filed criminal complaint, is still being held in Afghanistan, said Laura Eimiller, a spokeswoman for the FBI. She declined to comment further on the case.

Deleon and Santana, in conversations relayed or recorded by an unidentified paid FBI informant, spoke about traveling to Afghanistan to join Kabir and engage in "violent jihad," according to the criminal complaint. It said they described potential targets for attacks, including U.S. military bases.

Together with Gojali, they also visited a Los Angeles firing range and a paint-ball facility for shooting practice to prepare for further militant training overseas, the FBI has said.

Sky's Now TV service is continuing its uphill battle against the armies of Netflix and Lovefilm today, setting up camp in Roku's streaming boxes. Matching its Xbox 360 launch offer, you'll be able to try the service for 30 days without charge, but it's added another enticing deal for the Roku launch -- pay a reduced price of £8.99 for the first three months before the regular £15 per month fee kicks in. As well as boasting its exclusive Harry Potter catalogue suitable for a holiday marathon, we've been told Sky Sports will finally be coming to Now TV "in a few months." Sky 1, Sky Atlantic, Sky Arts and Sky Living will also eventually be added to the service, but there's still not even a loose date for those. SPRINGFIELD - I recently sat immersed in work at my computer when, out of the corner of my eye, I caught a glimpse of a large manila envelope that a member of my cabinet had left on my desk for me. A teacher had sent it inter-office mail to her. Affixed to the envelope was a note that simply said: "Thought you might enjoy these!"

Inside was a packet of drawings created by a kindergarten class at Beal School. Each drawing was a letter to the student's parents, asking their parents for help in making sure that they would get to go to college when they graduated high school.


Several of the kindergarteners promised to "be good" in college. Some asked their folks to "help them get money" to go to college. A few said they wanted to read big books in college or play college sports.

Others explained that they simply had to go to college because they wanted to be a doctor or lawyer. One child said he wanted to go to college so that he could become president of the United States.

Just two weeks before opening that envelope, I had stood on the front steps of City Hall flanked by hundreds of school children, college presidents, pastors, priests and rabbis, educators, legislators, business owners, community leaders, college mascots, reporters and news crews, community-based organizations, concerned citizens, parents and many other caring adults. We had gathered in support of a city-wide initiative called College?YES!, which was aimed at inspiring and supporting college goals for our students and their families.

The package of kindergarten letters that I unexpectedly received on my desk recently is further proof of what I already knew: that the College?YES! initiative was a worthwhile endeavor with unprecedented participation and success.

Those of us who work in the Springfield Public Schools are lucky enough to see the fruits of that initiative every day. But for many of the businesses and organizations that participated, the weekend-long event may seem to have been just that - just a weekend activity, which existed in a vacuum.

Let the letters that landed on my desk re-assure you of the substantial impact your efforts have made on so many of our students. As a city, we have collectively begun to root college aspirations in the minds of even our youngest students. The children who wrote these letters to their parents, for example, will enter first-grade, sixth-grade, ninth-grade, and become high-school seniors believing that college is a viable, reasonable next step post high school graduation.

Be assured that our schools have built a great deal of college aspiration momentum. Robust conversations continue. Special assemblies highlight career options. The college message is plastered throughout many hallways, classrooms and bulletin boards.
We continue to expand our capacities and we are racing to meet self-imposed improvement goals because we are committed to creating a district where all students graduate college and are career ready.

And we thank the Springfield community for sharing in that commitment.

PanARMENIAN.Net - BP has been temporarily suspended from new U.S. government contracts over the 2010 Gulf of Mexico oil spill, in a fresh blow that could have wide implications for its U.S. operations, Financial Times reported.

The U.S. Environmental Protection Agency announced on Wednesday, November 28 it had suspended the energy group ?due to BP?s lack of business integrity? as demonstrated by its conduct with regard to the Deepwater Horizon disaster.

The EPA said the suspension would temporarily prevent BP from getting ?new federal government contracts, grants or other covered transactions? until it could provide sufficient evidence that it met federal business standards. But it said the move did not affect existing agreements BP has with the government.

Under government regulations, suspensions generally may not exceed 18 months. But if there are ongoing legal proceedings at the time a suspension is issued, it can continue until those proceedings have ended. BP is facing trial on February 25 in New Orleans on civil claims arising from the disaster.

A person familiar with the matter said that to remove the bar, BP would have to show it has ?properly addressed the conditions which gave rise to the suspension?.

The U.S. Supreme Court on Monday turned down an opportunity to consider whether states can ban the insanity defense in criminal cases.

Most states permit a defendant to claim the defense of not guilty by reason of insanity.? It's not a medical term, it's a legal one, generally meaning that a person could not understand the difference between right and wrong and was, therefore, unable to act with criminal intent.?


Though long permitted, it has never been popular.? Between 1979 and 1995, five states decided to ban it -- Idaho, Kansas, Montana, Nevada and Utah.? A factor in the changing public sentiment was John Hinckley Jr's successful insanity plea when he was put on trial for shooting President Ronald Reagan in 1981.

The Supreme Court on Monday declined to take up a challenge from lawyers for an Idaho man, John Delling, who was convicted of killing two of his friends while, his lawyers contend, he was in the grip of severe delusions caused by acute paranoid schizophrenia. Because Idaho's law says that a defendant's mental condition "shall not be a defense to any charge of criminal conduct," he was unable to plead not guilty by reason of insanity.

Delling's lawyers argued that the Constitution's guarantee of due process demands that the insanity defense be available because it has strong roots in the legal system. And, they said, the ban on cruel and unusual punishment "forbids criminal punishment that violates broadly and deeply held Anglo-American legal practices." ?

Idaho defended its law, contending that "moral incapacity is only one of four different historical approaches to insanity in criminal cases, no one of which is constitutionally required."

Three justices, Stephen Breyer, Ruth Bader Ginsburg and Sonia Sotomayor, dissented from the court's refusal to take up the case.? "The law has long recognized that criminal punishment is not appropriate for those who, by reason of insanity, cannot tell right from wrong," they said.
