Oil and Gas Executive Sentenced to 2 Years Over Tax Fraud

The president director of local oil and gas services company Mutiara Virgo, Johnny Basuki, was sentenced to two years in jail on Monday over a fraudulent tax deduction that robbed state coffers of Rp 125.7 billion ($13 million).

Johnny was also ordered to pay Rp 100 million in fines, or serve an extra three months in jail. The sentence is less than the three years in prison and Rp 250 million in fines sought by prosecutors.

Johnny was found guilty of giving Rp 6.63 billion in bribes to then tax officer Herly Isdiharsono in order to reduce the company?s 2003 and 2004 tax obligations from a total of Rp 128.7 billion to a mere Rp 1.6 billion in 2003 and Rp 1.4 billion in 2004.

?[We] declare that defendant Johnny Basuki is proven validly and convincingly guilty of a corruption crime,? chief judge Sudjatmiko read out the verdict at the Jakarta Anti-Corruption Court.

?The defendant made other people, in this case Herly, rich. This was to make Herly do or not do something in his capacity as a tax officer,? judge Sofialdi added.

Prosecutors are seeking eight years in prison for Herly, a former officer with a Jakarta tax office who is standing trial separately over the same case.
