Music's ?Big Data? Problem Could Be Starving Artists of Revenue [Music]
If you won the Mega Millions lottery, what's your first act?

Venus Wilson has been fantasizing about winning the Mega Millions lottery. The first thing she would do? "Faint!" the security officer said at her post outside of JPMorganChase in Midtown Manhattan on Friday. "Then, when I get up, go get my check, and go shopping."
Wilson, 31,??has bought seven lottery?tickets. Other than passing out, she's got big plans if one ends up being a winner: She'd invest in real estate, but first, she would make sure her friends and family were taken care of.
"I would donate to St. Jude's for cancer research, for breast cancer, do stuff like that. Because come on, why not? Don't be stingy. God didn't bless you with it for no reason. Help people out. And I would pay off my parents' doctor bills, and I would help family and friends," she said.?"Then I?would go crazy [shopping]. I swear --?I would go crazy."
She also has plans to keep the cash flowing: Wilson wants to open soul food restaurants and laundromats, and get an accountant to invest her leftover winnings.
"You have to keep it coming. A lot of people, they win all that money, and then they're broke," she said. "Some people don't believe in the lotto. But look at the gold pot. It's like the leprechaun with the rainbow. That pot of gold is beautiful right now," Wilson said.
Wilson was among the New Yorkers canvassed Friday about?the?first thing they would do if they won Mega Millions, which has?hit $640 million. ?Hundreds more gave their responses on our Facebook page.

Therese Schoenwandt, 29, has been swept up by the lottery fever. The nursing student got engaged two weeks ago and sat in Barnes & Noble on Friday, flipping through "Wedding Planning For Dummies."?

Therese Schoenwandt, 29, a nursing student who recently got engaged, purchased a lottery ticket for the first time this week.
"I've never done a lotto ticket before. I usually don't believe in that stuff," she said. "It's all over the papers, and it's all over the news. Yesterday when I saw people lining up outside stores for it I said, 'You know what, I'm going to buy a ticket.' Peer pressure!"
Her first act if she wins: Pay off her mother's mortgage in Brooklyn. The she will plan?her wedding, and put the rest in the bank.
Ivan Martinez, 50, who was handing out fliers in Manhattan's diamond district, had high hopes of helping out his family back home in Puerto Rico with the one ticket he purchased earlier in the day. "It's a dollar and a dream," he said.
Richard Gallo, a 47-year-old customer service representative in the watch industry, said?if he won, the first thing he would do is jump in the car and drive. "Before I even turned the ticket in, I would take a trip. Wherever I ended up, I ended up. Basically just to step away from everything, think about it and come back. You get caught in that whirlwind."
Others weren't as confident about the dream's possibility. "It's all fixed," said a man who refused to give his name but was filling out his numbers for a ticket. "Do you know anyone who's won? It's all fixed, if you ask me." Then he continued filling out?his ticket.
As the Mega Millions Jackpot lottery winnings continue to grow, the NOW panelists discuss how the lucky winner is not the only beneficiary of the lucrative system.
On our Facebook page, many readers weighed in: "Sign the back of the ticket. Then go on a vacation to clear my mind while deciding who a good financial adviser would be to go to," wrote?Christopher Ringen.?
Others said they would pay off debt for family and friends or their churches, or donate to animal shelters. For some, though, it was just about making life a little more comfortable: "Never fly coach again," wrote Rebecca Hayes.
But not everybody has bought into the hype. "It doesn't really attract me," said Louis Carrasquillo, 50, a sales rep at Montecristo Cigar Shop on 5th Avenue in New York.
"Have I thought about it? Probably. I passed by the booth and I thought it would be great, but I'm just a working person. I'm not really a gambler."
If he did win that kind of cash, he would give money to his church for a new school and cafeteria, he said.
But?Carrasquillo?said he was turned off?by?some lottery tips he heard from a?newscaster: "If you're going to get divorced, get divorced before you win. What's that about??Change your phone number, 'cause you're going to hear from family members you haven't heard from. You gotta be kidding me."
Why even skeptics are rushing to buy a Mega Millions ticket
Mega Millions is played in 42 states plus Washington, D.C. Friday's drawing happens at 11 p.m. ET. The largest Mega Millions jackpot ever won was $390 million in March 2007, when the prize was split between two tickets sold in Georgia and New Jersey.

More Men Playing Women in Computer Games, and Why ? The ...
A great quote here courtesy of The Mary Sue, a thoughtful piece about men playing female characters in games, and what that says about the too-prevalent sexism in gaming culture. More importantly, it says something very important about the unexamined assumptions people make about men, women, and sexism.
I spend a staggering amount of time thinking about video games. I?m constantly chewing on the reasons for the character choices we make and how people are represented within games. I?ve spent a lot brainpower mulling over that stuff from a woman?s perspective, and I confess that for a long while, I hadn?t dedicated many neurons to wondering how our brothers-in-arms felt about those very same things.
I knew that there was a big difference between the groovy gamer guys I hang with and the snarling trolls that lurk elsewhere. I knew that some men do not speak for all men, and that male gamers are every bit as diverse as women gamers. But there was one point that I had made a rather mindless assumption on: that for most straight male gamers, the main reason for playing a female character was to have something nice to look at. I mean, if you?ve spent any time in a multiplayer game, you?ve heard the following phrase: ?If I?m going to look at an ass all day, I don?t want it to be a dude?s.? Even the most egalitarian gentleman can enjoy a bit of eye candy (who doesn?t?), and surely the plethora of cheesecakey box art and booth babes meant that the industry knew it was a view that most dudes shared.
But a few occurrences over the past few months got me thinking there was a lot more depth to the ?target audience? than was being talked about.
Mmmmm, thoughtful reexamination of gendered assumptions? I think that may be my new fetish.

Pinterest - are the new terms better? The Legal View | Social Media ...
There has been a lot of furor over the past few weeks about Pinterest and its terms and conditions.?? The debate crystallized in a blog post by a photographer who removed her pictures on the basis that Pinterest?s terms said it could ?sell? the pictures and claimed permanent ownership of any pictures ?pinned?.? Her blog went viral and prompted Ben Silbermann, the founder of Pinterest to get in touch with her?and ask how the terms could be improved to respect copyright.?
A clever PR stunt or a genuine intention to change?? Well it looks like the latter as early on Saturday morning, notice of the new proposed terms popped into Pinterest users? inboxes.?
So intriguing had this debate become that I was really keen to take a look for myself and check out whether the Pinterest terms scare stories had really been put to bed or whether they were still hiding out in the new terms.?
The email telling us of the new terms said they were an ?update?.? In fact it looks like the Pinterst lawyers went back to the drawing board and started afresh.? The tone is much more ?social-friendly?; it is clear, colloquial and has cut out much of the legal jargon.?? The headings are actually useful, giving good guidance about what it covers: ?Your Content?, ?How long we keep the content?, ?How Pinterest and others can use your content?.?? Instead of the unknown and slightly sinister sounding ?Cold Brew Labs? the terms are with the name we know, Pinterest.?
So far, so good. Now?let?s take a look at the legal nitty gritty:?

Pinterest no longer claims the right to sell your pictures?
That right. the offending word ?sell? is gone from the new terms altogether.? Other legal rights that they have removed are ?publicly display?, ?publicly perform?, ?transmit?, ?stream?, ?broadcast?, ?access?, ?view? and the all encompassing ?and otherwise exploit?, terms that seemed irrelevant to what Pinterest actually does.

The new licence seems very specifically tailored to what Pinterest might genuinely need to do with our content to display pictures on the site globally and allow others to re-pin our pictures.

Pinterest no longer owns my pinned pictures forever?
Correct.? Pinterest has removed the ?perpetual? licence.? In fact even in the current terms (the new terms start as from 6 April), Pinterest did not claim ownership of our pictures. They just kept a licence.? Forever.?
?
The new terms are more in line with other social media sites (specifically Facebook, Twitter and Flickr) where, once?you terminate?your account they only keep my content to the extent it isn?t deleted completely for technical reasons (e.g. caches or backups).?
But there is a loophole.? There is a perpetual licence to anyone who re-pins your pictures which means that if?you decide to remove all?your pictures from the site, any re-pins will stay.? So, if my pictures are popular and get re-pinned, you'?ve lost the control and can?t get them back.? In that way it is much like Twitter; deleting a tweet or my account does not remove the tweets?you have sent.?
I think there is a crucial difference in the time-based nature of tweets.? They are very much in the moment.?? In contrast, our pictures are always our pictures, whatever the timeline.? It will be interesting to see how the community reacts to this loss of control.? It should certainly make us all think twice before we pin any pictures we may one day want to remove?

I have to indemnify Pinterest for any copyright problems?
Yes ? this one stays. ?In fact is has been extended slightly in terms of legal scope.? In legal terms there is an unlimited indemnity for any losses suffered by Pinterest from our use of the site.?

In layman?s terms, that means if Pinterest is sued by someone because?you have pinned a picture belonging to someone else (which let?s say they has then been extensively repined by the Pinterest community) Pinterest can demand?you pay all the lawyers? fees and damages.? Ouch!? There is nothing so punishing in the Facebook or Twitter terms.

However, this is not an unheard of term in social media.? And, again, perhaps this is different because we are focusing on pictures.? If you take a close look at the Flickr (i.e. Yahoo!) terms of use, the indemnity is even more potentially harmful to the user.??You would have to pay them even if they fight the case and they win and the Court finds that my picture does not infringe copyright.? So in theory, you?could have done nothing wrong and still face a huge legal fees bill.? This is due to the deceptively innocent wording of the Flickr indemnity ?for any claim or demand? (emphasis added).?
If I pin a picture of my brand, Pinterest could reproduce this brand picture anywhere?
No.? But Pinterest and any other user could reproduce it within the Pinterest site.? If say, we posted a picture of an eModeration mug (we?re very fond of tea at eModeration Towers), we would have granted a worldwide licence to Pinterest and other users to use that picture featuring our brand anywhere within the Pinterest site.?

The licence to Pinterest and other users does not allow them to reproduce the brand other than in that particular picture.? Even so, this should give some brands cause for concern when looking to create a presence on Pinterest.?

If?you do anything other than pin pictures?you have taken,?are you?infringing copyright by using Pinterest?
Potentially, yes.? This hasn?t changed, although the language which describes this liability is much more friendly and in a tone more acceptable to social users.

Pinterest?s current terms demand a full reassurance from users that they own the rights to pin a picture.? Given that we can add a ?pin it? button to our tool bar and are encouraged to pin from websites, this seemed disingenuous at best.? The impression was that Pinterest was ignoring the reality of the copyright challenge presented by its concept: we can pin content from anywhere (but we are unlikely to have the rights to do that).
Legally the situation has not changed.? Presentationally, it is hugely different.? The emphasis is on personal empowerment and responsibility for us, the users, to check we have the rights to repin.? A link to resources (an FAQ page from San Franciso University) is provided.?
We are still left with the problem that the beauty of Pinterest is we can gather pictures from all over the web in one place to share with others.? But most websites do not grant us the rights to do this.?? It remains a risk and, in my view, the biggest legal challenge to Pinterest?s success.
Pinterest has launched code to allow sites to prevent pinning ? does this help?In legal terms, no.? Pinterest cannot turn global copyright licensing into an opt-out regime (i.e. site being deemed to have granted a licence if they do not implement the code).?
In practical terms, probably.?? With the availability of this code, the incentive to a site owner to take legal action against Pinterest (which the offending user would be paying for remember) is massively reduced.? They do not have to resort to legal action to stop the infringement; they can just implement the code.
Summary
The new terms are a huge improvement and represent a big step in Pinterest engaging with the legal reality of its concept and listening to the concerns of its community.?

On the positive side:
- We don?t need to worry about Pinterest selling our pinned pictures;
- Pinterest does not take ownership or a permanent licence for our pictures
- The release of the no pin code reduces the risk of anyone taking legal action against Pinterest (and thus us, the users) for pictures we pin
But there are still some real risk and concerns:
- It is likely that we (and Pinterest) are infringing copyright for much of the content we pin from the web.?
- The indemnity we give to Pinterest is very broad.? If a site owner decides to bring a test case the user is potentially on the hook for paying for that.
- Once our pictures are repinned, we have lost control of them.? Even if we terminate our account, they will stay up there.?? So, make sure you are happy for that to happen before you post any pictures.
Overall, well done Pinterest, but could do better.??? We feel a lot more comfortable for us and our clients to use Pinterest but there is a need for caution about what pictures we all pin.?

Genetic abnormality offers diagnostic hope for children's cancer ...
A chromosomal abnormality in children with a deadly form of brain cancer is linked with a poorer chance of survival, clinician scientists at The University of Nottingham have discovered.
The study led by experts at Nottingham?s Children?s Brain Tumour Research Centre as part of a European collaboration could potentially lead to a new diagnostic test to allow doctors to identify youngsters who are at the highest risk associated with an ependymoma tumour and may need aggressive life-saving treatments.
The research could also help them to decide which children with the tumour have a better prognosis and would benefit from less intensive therapies, reducing their exposure to a range of side effects which can cause permanent disabilities, having a debilitating impact on them for the rest of their lives.
The study, published in the April 1 edition of the journal Clinical Cancer Research, focused on looking at abnormal copies of chromosomes in the cells of ependymoma tumours and aimed to establish whether it was associated with a worse outlook for children suffering from the disease.
The research, led by Professor Richard Grundy and Dr John-Paul Kilday, found that increased copies of a specific region of a chromosome called 1q25 were associated with around 20 per cent of the 147 tumours they tested from European children with ependymoma and that it was associated with a worse outcome in younger children treated with surgery and chemotherapy.
In addition, when combining the results for 1q25 copy gain with how much tumour was removed at the time of surgery, the scientists could accurately place the children into three risk groups ? high, intermediate and standard.
Dr Kilday said: ?This study is the first to assess copy number gain like this in groups of children with ependymoma who have been treated in a similar way and is an important step forward in being able to predict the future for children with these brain tumours?
?We are now hoping that these findings are reproduced in other studies currently underway in other countries, including the USA? added Professor Grundy, ?If their results match ours, then the presence of 1q25 copy gain in childhood ependymoma could be introduced into future international treatment planning as a new marker of poor outcome which will in turn define treatment. We would intend that this should be something each patient?s tumour is tested for at the time of diagnosis.?
Ependymomas are brain tumours that can occur at any age but are more common in children. Despite improvements in therapy over recent years, the prognosis for children with this cancer remains poor ? 40 per cent of affected children still die.
One of the reasons that survival for childhood ependymomas has not improved is that, until now, doctors have not been able to accurately predict which tumours will behave more or less aggressively than others. Factors that have helped the ability to predict outcomes in other cancers, such as patient sex, age, how much of the tumour is removed and how aggressive the tumour appears under the microscope, have not been found to be consistently reliable in previous studies.
In normal humans, the cells which make up our body tissue contain chromosomes made up of DNA and proteins ? the building blocks of life. Normally, our cells have two copies of 23 chromosomes (numbered 1 to 22) plus two sex chromosomes, making a total of 46 chromosomes. Each chromosome has two arms ? a short arm called the p arm and a long arm called the q arm.
In tumour cells the number of chromosomes can vary significantly from the normal cell numbers and in ependymoma a frequent finding from biological studies is increased copies of chromosome number 1, specifically increased numbers of the long arm of chromosome 1. This abnormality is termed 1q copy number gain.
For the Nottingham-led study, the scientists assessed the results from 147 brain ependymomas in young UK and French children who received tumour surgery followed by chemotherapy and older European children who received tumour surgery followed by radiotherapy.
Copy number gain of 1q in the ependymoma cells from each of the 147 patients was assessed using a technique called fluorescence in situ hybridisation (FISH) in which pieces of DNA called probes are made in the lab containing a fluorescent dye. This enables the tumour cells to be seen down a fluorescent microscope. In the Nottingham project, the scientists used a green probe that bound to a region within chromosome 1q of the tumour cells, called 1q25.
The team then linked which of the ependymomas had increased copies of the 1q25 probe in their cells to corresponding patient data to work out whether increased copy number gain was associated with a worse survival rate.

Bully Will Open Unrated
In an attempt to get around the MPAA?s nearsighted ?R? rating for Lee Hirsch and Alicia Dwyer?s award-winning documentary, Bully, The Weinstein Company has announced that they will release the film as Unrated. Bully, which investigates the prevalence of bullying in our nation?s schools, was hit with an ?R? rating after an appeal by TWC came up one vote shy, regardless of a petition signed by nearly 500,000 individuals who felt that the rating would limit kids? ability to see the film.
The reason for the rating? A few instances of foul language, something that occurs in hallways and school buses on a daily basis. By restricting the film to kids who would need a parent or guardian present to attend, the MPAA has become the bully themselves. Unfortunately, many theaters won?t show unrated films, which now precludes both the children and their parents from being able to see the film at all. At least Gerry Lopez, CEO of AMC theaters, has taken a stand in support of the film, saying that his theaters will show it regardless of the unrated status. The Weinstein Company has announced that ?Bully,? the award-winning documentary about the epidemic of school bullying in the United States, will open in theaters on March 30 as ?unrated? after nearly 500,000 people signed an extraordinarily popular online petition at Change.org demanding that the Motion Picture Association of America (MPAA) remove the ?R? rating initially given to the movie by the MPAA?s ratings board.
?I am happy ?Bully? will maintain its authenticity and will
be an accurate portrayal of what thousands of kids experience every day,? said Katy Butler, a bullied high school student from Michigan who was outraged that the MPAA gave ?Bully? an ?R? rating by just one vote because of brief language. Butler, who had her finger broken by bullies in middle school, urged the MPAA to remove the ?R? rating from ?Bully? so that middle school and high school students would have a chance to see a movie that could potentially save their lives.
?The MPAA might not recognize the reality that thousands of bullied kids face each day in school, but nearly 500,000 people around the country, from celebrities to politicians to bullied kids themselves, stepped up to speak out about bullying by signing my petition,? said Butler. ?The brief use of explicit language in this film reflects what so many kids hear each day in school when they?re being bullied. The MPAA said they wouldn?t drop the ?R? rating unless this language was removed, but nothing can remove it from the halls and playgrounds of schools where bullied students hear it each day, except education and exposure.?
Lee Hirsch, director of ?Bully,? said that the ?unrated? designation for the film will allow the film to portray the real trauma and torment that bullied students experience each day in school.
?The small amount of language in the film that?s responsible for the ?R? rating is there because it?s real. It?s what the children who are victims of bullying face on most days,? Hirsch said in a statement put out by The Weinstein Company announcing the ?unrated? designation. ?All of our supporters see that, and we?re grateful for the support we?ve received across the board. I know the kids will come, so it?s up to the theaters to let them in.?
Gerry Lopez, the CEO of AMC Theaters, one of the largest movie theater chains in the world, signed Katy Butler?s Change.org petition. ?He said previously in a statement that he will make sure ?Bully? plays at AMC Theaters even with an ?unrated? rating.
?AMC will show this movie, and we invite our guests to engage in the dialogue its relevant message will inevitably provoke,? Lopez said.
Lopez is just one of several high profile individuals who signed Butler?s campaign on Change.org. Ellen DeGeneres signed the petition, inviting Butler to appear on her show and urging her viewers to support the petition, and Anderson Cooper, Kelly Ripa, Justin Bieber, Johnny Depp, Meryl Streep, Michael Jordan, Demi Lovato, Randy Jackson, and Drew Brees all encouraged their fans to show support to ?Bully,? objecting to the ?R? rating it received.

What Type of an Entrepreneur Are You? - Judith Leist
When asked on a regular basis ?what do you do?, I almost always reply that I am an Entrepreneur. More frequently than not this inevitably leads to the question: ?yes, but what is that you do?? ? as though being an entrepreneur is not specific enough as a clearly definable day-to-day activity or a valid enough qualification!
Many entrepreneurs forget that they are NOT defined by their business or businesses. Yes, an entrepreneur owns and operates a business and assumes significant accountability for the inherent risks and the outcome of that enterprise but should that venture start making losses or fail altogether ? the business is ultimately a failure ? not the entrepreneur. But what is the real definition of an entrepreneur and why does it matter what type of an entrepreneur you are?
Tracing back its roots to 1950 our understanding of entrepreneurship owes a lot to the work of Joseph Schumpeter (economist) who defined an entrepreneur as a person willing and able to convert a new idea or invention into a successful innovation. Further in 1959, Cole further defined four distinctive types of entrepreneur:
1)????? The innovator
2)????? The calculating inventor,
3)????? The over-optimistic promoter,
4)????? And finally, the organization builder.
These entrepreneur types are not related to the?personality?of the entrepreneur but more to the type of opportunity the entrepreneur will inevitably be attracted to and the problems that they will face (or so Cole thought).
Nowadays, Cole?s categories, though very applicable are broken down in varying ways, but the main entrepreneurial categories that are agreed upon are:
1) The Lifestyle Entrepreneur:
This is someone who has decided to build a business to make a living and to satisfy his or her own personal motivations. This entrepreneur would like to create a successful company ? but?building a company to be listed on the Nasdaq?would definitely NOT be?a driving force. Instead this entrepreneur would be more?likely to be ??income statement affluent??over any of the other types of Entrepreneurs listed ? and the choice of businesses he or she would choose to be involved with?would generally?be non-scalable, but usually cash generative businesses.
2) The Empire builder:
This particular entrepreneur?would be classed as ?balance sheet affluent?. This entrepreneur buys ? but does not easily?sell, usually stubbornly choosing to go ?long? on all of his investments and business decisions. This Entrepreneur would not really consider selling or exiting from his company, unless it was absolutely essential or involved members of the board physically dragging him/her out of their presidential chair.
3) The Serial Entrepreneur:
It is fair to state that this entrepreneur?s main motivation will be the cash payout on the exit or sale of their venture so that they are able to move on and build their next company. The serial entrepreneur has mixed reviews amongst Angel Investors as they usually have less skin in the game than say an empire builder, however, Angel investors that invest in a serial entrepreneur can leverage their broad experience base and their focus on the businesses trade sale which is in alignment to most angel investor?s investment criteria.
A study published in late 2004 by the Canadian Federation of Independent Business pointed out that entrepreneurs are commonly believed to have special traits that make them successful. For instance, entrepreneurs are commonly seen as being especially skilled at spotting new business opportunities, or they are regarded as brash or aggressive and ready to take greater risks than their peers. However, the study adds, despite a lot of academic study ?no one has been able to identify a truly unique set of entrepreneurial personalities.?
A similar view is proposed by the Center for Bioscience, part of the Higher Education Academy at Leeds University in the UK. ?Increasingly, it is recognized that at least some (and probably the majority) of the skills associated with entrepreneurship, and how to apply them successfully, can be learned,? it says.
Dr Pauric McGowan, Director of the Northern Ireland Center for Entrepreneurship, believes that entrepreneurs are both born and made with some people born with entrepreneurial traits and behaviors. Success depends on developing these traits but also learning skills, such as management skills. He also believes that everyone has the potential to become an entrepreneur and that entrepreneurial traits and skills are useful in well-established businesses, where they can be used to improve, for example, the running of the business.
My personal belief is that entrepreneurialism is not reserved to certain types of individuals only. Instead I truly believe that anyone is capable of being an entrepreneur as long as they are placed into the circumstances that would nurture the need for them to create an environment for themselves in which they can prosper (or not) but?at their own terms.?A common theme amongst successful entrepreneurs seems to be that they ?had no choice in the matter? and that it was through necessity that they had to think and work outside of the box to succeed.
Whatever your personal belief is in this matter, and whether you believe entrepreneurs??are born through nurture or nature, the fact remains that living outside of one?s comfort zone, and having the stomach to do this on a regular basis is key to an entrepreneur?s success especially in the start-up stages of his/her company.?What I also find personally curious is that Coles 1950s distinctive entrepreneur profile types can still be applied to each of the three widely accepted entrepreneurial types above. It?s surprising because even now, almost 60 years on, whilst many elements of our market place and economy have changed, the basic entrepreneurial philosophy has not, and probably never will, for as long as we operate within a ?free capitalist? society.

In a rich and very illustrious high school, there's this game that the students play, basically, a hyped-up version of the children's game known as Kiss Chase.
At the beginning of the year, All Seniors and Freshman are "forced" into it, as a part of initiation and a goodbye.
(Sophomores and Juniors are spared unless they join voluntarily)
The game expands through the whole school year, and the last person to have gone without being kissed gets a prize of their choice,
from a beautiful car, to tons of money, or anything else they can think of.

The cops arrest the robbers by tagging, and put them in jail. Robbers can stage a jailbreak by tagging one of the prisoners without getting tagged themselves.
The game ends if all the robbers are in jail. In a variant, the robbers have 5 minutes to hide before being hunted, and only one jailbreak may be allowed per robber.
